Terms and conditions governing the promotion

Definitions:

Prize Draw:The prize draw is operated by the promoter to which these terms and conditions apply and wherein the entrants submit entries via the website www.dine-nation.com

Competition: The competition is operated by the Promoter to which these terms and condition apply wherein the entrants submit entries via the website www.dine-nation.com

Prize: x12 £50 Dine experiences. One winner will be drawn at random each month. Booking by the Winner & Promoter to chosen restaurant must be made within 30 days of when the Winner is notified.

Entry: Submitted through the website link by the entrant.

Entrant: Anyone who registers their details through the website and consequently enters the competition.

Winner: The entrant with who is drawn at random by the Promoter.

  1. By entering the competition via the Website, Entrants are deemed to have read
    and accepted these terms and conditions and agrees to be bound by them
  2. The Promoters reserve the right to amend these terms and conditions at any time and for any reason.
  3. The Promoters decisions in regards to the competition are final and no correspondence will be entered in to.
  4. The Promoter will not be responsible to you for any of the following that may occur, whether directly or indirectly connected with the Website or otherwise: (i) error, omission, interruption, deletion, defect, delay in operation or transmission (ii) communications line failure; (iii) theft or destruction of or unauthorised access to, or alteration of, any entry; (iv) lost, late, misdirected or otherwise failed entry; or (v) computer, online, telephone or technical malfunctions. In the interests of fairness, The Promoter reserves the right to remove entries deemed to be invalid due to technical issues.
  5. Privacy policy - The Entrants and the Promoters recognise that the Promoters may use contact details and other data including personal data as defined by the Data Protection Act 1998 supplied by the Entrants to the Promoters to administer the Website and conduct the Competition according to these Terms and Conditions. The Entrants and the Promoters also recognise that the Promoters may (either by choice or at the request of a third party) also disclose this information to relevant third parties for the purposes of the prevention of fraud, money laundering, legal or other financial or regulatory reasons.
  6. The Entrants and the Promoters recognise that the Competition, its administration and all associated activities are governed by English Law and the Promoters, and Entrants recognise that the County or High Courts of England shall have exclusive jurisdiction in the event of any dispute arising out of the Competition or its administration;
  7. You agree that, except and to the extent that it is not permissible by law to exclude liability (such as liability for death or personal injury arising from negligence or fraud),we, our subsidiaries, affiliates, related companies and employees, and any other sponsors, advertisers and promotional agencies shall have no liability to you in connection with your taking part in, or not being able to take part in, the Competition, or otherwise in connection with the Competition, or in connection with the acceptance, possession or use of any prize awarded herein.
  8. Upon entering the Competition, all Entrants must submit all contact details requested by the Promoters (which must include a valid e-mail address) which will be used for the following purposes: (a) to notify the Winner that they have won the prize; (b) to post the Winner's name on the Website; and (c) to comply with the Privacy Policy.
  9. All entrants are solely and completely responsible for providing the Promoters with accurate and current contact details. The Promoters will be in no way liable for any failure or inability to make contact with any Entrant due to any errors, omissions or inaccuracies in the contact details provided by the Entrants or otherwise. Any of your personal information, including, without limitation, your name, age, address, (including postcode), telephone number and/or email address which is obtained by us by virtue of you entering the Competition may, with your consent, be used by us for certain marketing, market research, analysis and related purposes, please refer our general policy for more details on the use of such personal information and your right to remove your personal information from our database.
  10. Any of your personal information, including, without limitation, your name, age, address, (including postcode), telephone number and/or email address which is obtained by us by virtue of you entering the Competition may, with your consent, be used by us for certain marketing, market research, analysis and related purposes, please refer our general policy for more details on the use of such personal information and your right to remove your personal information from our database.
  11. Entrants should retain a copy of these terms and conditions for their future reference Competition
  12. By entering the Competition, Entrants warrant that all information, which they submit, is accurate, true, current and complete.
  13. The Competition is operated and hosted by the Promoter
  14. The Competition is governed by English law and the Promoter and Entrants hereby irrevocably submit to the exclusive jurisdiction of the English courts.
  15. Twelve competition winners will be drawn, one Winner on the last day of each month, commencing in November 2009. 
  16. The Promoter may cancel the competition at any time.
  17. The Competition is open only to citizens of the United Kingdom (excluding Northern Ireland). Entrants must be aged 18 or over. The Promoter reserves the right to implement additional age requirements where necessary.
  18. The Competition is not open to Spirit Marketing Group employees and their immediate families, affiliated companies and subsidiaries, their advertising and promotional agencies, any and all sponsors or the immediate family members of those people.
  19. Entry is limited to one entry per person. 
  20. There is no charge or purchase necessary to enter. 
  21. The Promoters reserve the right to disqualify any entrant (entirely at their own discretion) if there are reasonable grounds to believe the Entrant has acted in breach of any of these Terms and Conditions
  22. The Winner will be requested to participate in post-competition publicity.
  23. All Entries will become the property of the Promoters on receipt and will not be returned
  24. Only completed Entries will be entered into the Competition
  25.  When the Closing Date is reached, the Competition will close; however the Promoters reserve the right to extend the closing date at their discretion.
  26. No correspondence will be entered into about the result of the Competition following the determination of the Winner Prize
  27. In the event of the stated prize becoming unavailable the Promoter will, where appropriate, arrange the supply of an appropriate alternative of similar value at the Promoter’s sole discretion.
  28. A prize will not be awarded to a person who, for any reason, would not be allowed by law to purchase or use the prize where the supply to that person would be unlawful.  All entries to the competition must be over 18. 
  29. The Promoter will randomly draw a winner from the competition registration each month
  30. Winners will receive up to £50 to spend on a dining experience at any of the participating restaurants of Dine 2009.  Winners will be e-mailed to request a preferred restaurant, date and number of diners. 
  31. The Winner, of any of the prize components of the Competition is conditional upon their compliance with these rules and with any and all applicable laws, rules and regulations. As a winner, you are solely responsible for all insurance, applicable taxes and for any expenses not specified in prize descriptions.
  32. Prizes are non-transferable and non-exchangeable in full or in part and there will not be any cash alternative. Winners may not make any change to prizes. Prizes are subject to the terms and conditions of the restaurant/supplier. Spirit Marketing Group will not liable to refund or reimburse Winners for any cancelled or non-attended reservations/bookings at or by the restaurant. 
  33. The Winners acknowledge that, in relation to any prize, including (but not limited to) in relation to its quality or condition, the Promoter does not give representation, or guarantee on behalf of the Winner (whether express or implied, in fact or in law), and to the maximum extent permitted by law, we are not responsible or liable to you for any such warranty as may be given by anyone or implied.
